These terms of service ("Terms") govern your access to and use of the Meteologix AG ("Meteologix", "we", "our" or "us") API service ("Service") for weather data. By using our Service, you agree to be bound by these Terms. If you don't agree to these Terms, you may not use the Service.
1. License
Subject to these Terms, Meteologix grants you a non-exclusive, non-transferable, revocable license to use the Service and to access the weather data made available through the Service for your internal business purposes or for personal use only. This license is granted solely to you and cannot be shared with or used by any third party.
1. Endpoint: An endpoint is a URL that is used to access a specific service or resource, in this case, a weather API service. Weather API endpoints can provide data for current weather conditions, weather forecasts, historical weather data, and more.
2. Request: A request is a message sent by a client (in this case, your application or program) to a server (the weather API service) asking for some data or action. When making a request to a weather API, you may include parameters such as location, time range, data format, and other options to customize the data you receive.
3. Response: A response is the data sent back by the server in response to a client's request. In the context of a weather API, the response may include current weather conditions, forecasts, temperature, humidity, wind speed and direction, and other relevant information.
4. Authentication: Authentication is the process of verifying the identity of a user or client to ensure that they are authorized to access the requested resource. Weather API services may require authentication to access certain features or to protect sensitive data.
5. Rate limiting: Rate limiting is a technique used to control the amount of traffic or requests that are sent to a server, typically to prevent overload or abuse. Weather API services may have rate limits in place to ensure that their servers can handle the volume of requests they receive and to prevent individual clients from making too many requests in a given time period.
2. Service Packages
The Service is offered in the following packages:
- Private/ Private Smart Home (private use only)
- Business Starter (commercial use)
- Business Standard (commercial use)
- Business Professional (commercial use)
- Business Enterprise (commercial use)
3. Access to the Service
To access the Service, you must register on our website, select a package that best suits your needs and obtain an API key. Each package provides access to different endpoints and products, which are specified in our documentation. You are responsible for maintaining the confidentiality of your API key, and you must not share it with any third party. You are responsible for all activities that occur using your API key, whether or not authorized by you. You agree to immediately notify us of any unauthorized use of your API key or any other breach of security.
4. Use of the Service
You may use the Service only in accordance with these Terms and applicable law. You may not use the Service to engage in any activity that:
- violates any law, regulation or ordinance;
- infringes any right of any third party, including but not limited to any intellectual property right, privacy right, or right of publicity;
- is fraudulent, deceptive or misleading;
- is harmful or threatening to others;
- damages, disables, overburdens or impairs the Service; or
- attempts to gain unauthorized access to any portion of the Service.
5. Weather Data
Meteologix offers access to a large number of weather data, models and forecasts, some of which are collected by third parties, via the service. While we strive to provide accurate and timely weather information, we cannot guarantee the accuracy or completeness of any weather information made available through the Service. In particular, data relating to severe weather should only be used as a supporting, preliminary planning aid and does not replace official notifications and your own observations. You should always monitor and assess your current situation and follow official notices. Kachelmann GmbH does not guarantee or guarantee that the service with its content and functions will be uninterrupted, secure and error-free and that it will meet the requirements and wishes of the user. You are solely responsible for your use of the Weather Data and for any consequences resulting from your use of the Weather Data.
6. Intellectual Property
Meteologix owns all rights to the Service, including all intellectual property rights. Except as expressly granted in these Terms, you are not granted any license or other right under any intellectual property rights owned or controlled by Meteologix or its licensors. You may not remove or alter any copyright, copyright or other proprietary notices on the Service. The Service, including all intellectual property rights therein, is and will remain the property of Meteologix or its licensors. Customer acknowledges that Customer is granted only a limited right to use the Service and that no ownership rights are transferred to Customer hereunder.
7. Termination
We may terminate your access to the Service at any time for any reason or for no reason. You may terminate your use of the Service at any time by cancelling your subscription with us in your account at https://accounts.meteologix.com/
8. Billing
The customer signs up on our website and then buys a package. The billing is then done automatically every month (on every bought term) via Stripe. The customer is able to set usage limits, so the volume-based pricing does not come as a surprise. The customer can terminate at any time online.
9. Payment Vendor
Meteologix AG uses Stripe as its payment vendor. By using the Service, you agree to Stripe's Terms of Service, which are available at https://stripe.com/terms.
10. Limitation of Liability
Meteologix AG shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to, loss of profits, business interruption, loss of information or data, arising out of the use of, or inability to use, the Service, even if Meteologix AG has been informed of the possibility of such damage. Meteologix AG's liability for claims arising from this Agreement will not exceed the fees paid by Customer for the Service during the 12-month period prior to the occurrence of the event giving rise to such claim.
11. Disclaimer of Warranties
The Service is provided "as is" and without warranties of any kind, express, implied or statutory, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. Meteologix AG does not warrant that the Service will meet your requirements or that the Service will be uninterrupted or error-free. Meteologix AG does not guarantee or warrant the accuracy, completeness or reliability of any information obtained through the Service.
12. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Switzerland, without giving effect to its principles of conflicts of law. The parties irrevocably agree that the courts of Schwyz, Switzerland, shall have exclusive jurisdiction to settle any dispute arising out of or in connection with this agreement.
13. Changes to Terms of Service
Meteologix AG reserves the right to modify or replace these terms of service at any time. What constitutes a material change will be determined at the sole discretion of Meteologix AG.
